Privacy Policy – SPOT Park, LLC

SPOT Park, LLC (“we”, “our” or “us”) believes in your privacy and sharing opinions on or our Android and iOS applications (we refer to all of these collectively as the “Site”). Our lawyers drafted this privacy policy (this “Privacy Policy”) to protect the collection, use and disclosure of your information on the Site and the services, features, content or applications we offer (together with the Site, the “Services”). Please read it! This way you’ll know how we collect and use your information and share it with third parties. By using any of our Services, you are automatically agreeing to the collection, transfer, manipulation, storage disclosure and any other things we do with your information in accordance with this Privacy Policy.

What Does This Privacy Policy Cover?
This Privacy Policy covers both
(1) the treatment of any and all information (“Personal Information”) that is unique to you and gathered when you use or access any of the Services and
(2) Personal Information that our business partners share with us or that we share with them.

Information we Collect
We may request, collect and/or display some of your Personal Information when using the Services. It helps us make the Site better, send you information, improve content, operate the Services, offer promotions, and customize ads.

Account Information
When you create an Account, you will provide information that may be Personal Information, such as the following:

Parking Space Owners
Physical Address
Phone Number (preferably a mobile phone capable of receiving text messages)
Email Address
PayPal or bank account information (processed via third parties – please see below for more information)
Photo or Google Street View of the parking space listed
Feedback on renters

Parking Space Renters
Mobile Phone Number (text message functions must be enabled)
PayPal, bank account or credit card information (processed via third parties – please see below for more information)
Vehicle license plate number & vehicle make, model, color and year

Feedback on parking space owners
Personal Information also includes your Site log-in credentials, password, transactional information based upon your activity on the Site (information we need to get paid and to pay you), user feedback and comments, demographic information, and authentication information. Some of this information is mandatory and some is optional. For example, we need to locate your address for the parking space and locate you in real-time if you are driving around looking for a parking space so that we can make recommendations to you for the nearest parking spot. We will track the parking transactions in real-time and have this data visible on our site through the use of Google Maps. You acknowledge that this information is your Personal Information and by creating an Account, utilizing the Services and providing Personal Information to us, you allow others, including us, to identify you. When you use any of the Services, we may know your location and you agree that we may contact you, as needed, for such housekeeping matters.

Locational information
All of our Services are location-based, so in order to provide them we need to collect and store information about your location in real time as you use the Services, whether you are searching for a spot to rent or completing a transaction. This information can come from a variety of sources depending on the client you use to access the Services; for example, a mobile phone may report its GPS location at the time you access our Site or Services.

Financial information
We do not currently collect financial information, such as your payment method (valid credit card number, type, expiration date or other financial information); that information is collected and stored by our third party payment processing company (the “Payment Processor”), and use and storage of that information is governed by the Payment Processor’s applicable terms of service and privacy policy. You should review their privacy policies and terms so in detail.

User Content:
We want you to share your thoughts with us so that we can improve the Services for you and our other customers. In fact, we ask you to rate parking space owners and renters (as applicable) after the transaction so that we know which people and spaces our users feel are the best. When you provide feedback, we get to keep that data indefinitely, even after you terminate your Account. As long as we don’t share your Personal Information with third parties, we may continue to disclose other content to third parties as described in this Privacy Policy.

User Supplied Information:
Sometimes we ask you to complete surveys, answer questions, and provide other information for us or our partners. If you want to answer us, that’s great! If not, that’s totally fine, too. Though in some instances, you may not be able to access the Services if required information is not provided.
IP Address Information and Other Information Collected Automatically: When you access the Site and use the Services, we automatically receive and record certain information from you, including your IP address, location, browser or mobile platform, cookie information, and page information you requested. Generally, this information is collected and used in the aggregate so that we can make the Services better. We treat this information as non-Personal Information, except where required to do so by applicable law.

We send you email and text messages.
In order for us to communicate with you in real-time and most quickly enable a parking space transaction, we need to email and text message you directly. Please be advised that your mobile phone carrier’s data and text message rates will apply. By using any of the Services, you are automatically giving us permission to send you text messages and emails regarding the transactions you request. We track when you open emails so that we can improve the Services for you and all our customers. If you cannot be reached this way, then it will be challenging for you to use the Services. Other than for transactional and Account-related matters, if you don’t want to hear from us, just unsubscribe. We will not send you text messages for anything unrelated to the specific Services you request.

Information Collected Using Cookies: Here is some basic information about cookies: (1) they are pieces of information that may be provided to your computer, mobile phone or tablet through your web browser when you access a website; (2) your browser stores cookies for each website you visit; and (3) we use cookies to enable our servers to recognize your locational data, mobile or web browser, and to tell us how and when you visit the Site and otherwise use the Services. Our cookies don’t, by themselves, contain Personal Information. We use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your Account (if you have one). Most browsers have an option to turn off the cookie feature, which prevents your browser from accepting new cookies, as well as allowing you to decide whether to allow any new cookies. We recommend that you leave cookies active, as they enable you to make the most of our Services. Our advertising partners may deliver cookies to provide targeted ads to you. Our Privacy Policy just covers what we do – not third parties who send you cookies or their data usage. You can opt out, but it may limit your ability to use the Services.

Information Related to Advertisements and the Use of Web Beacons: We may include third party advertisements on the Site. Sometimes the advertisements are targeted to particular users, sometimes they are based on Personal Information (i.e. location, gender), Services usage patterns, or your activity on Third Party Services. Sometimes ads are anonymized. The information collected is only linked to an anonymous cookie ID (alphanumeric number); it does not include any information that could be linked back to a particular person, such as their name, address or credit card number. We may deliver a file (known as a “web beacon”) from an ad network to you through the Services. Web beacons allow ad networks to deliver targeted ads and to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Because your browser must request these ads and web beacons from the ad network’s servers, these companies can view, edit or set their own cookies, just as if you had requested a web page from their site. The information used for targeted advertising either comes from us or through third party website publishers.

Aggregate Information:
We love information – it helps us improve our products and make our Site and the services better. We collect statistical Information about how both unregistered and Account users, collectively, use the Services (“Aggregate Information”). Some of this Aggregate Information is derived from Personal Information. However, statistical Aggregate Information is not Personal Information and can’t be tied back to you, your Account or your web browser. Certain non-Personal Information that could become Personal Information is aggregated with other pieces of data in a way that enables you to be identifiable. We may at times combine non-personal information with Personal Information to better deliver the Services and special offers and advertisements to you and also to better understand how our Site and the Services are used. In the event that such data is combined, it will not be shared with third parties.

Who do you share my information with?
Third parties that help us improve the Services.

IP Address Information:
We collect and store IP address information, but we do not make it public. Sometimes we share this information with our partners, service providers and other persons with whom we conduct business, as we describe in this Privacy Policy.

Information Collected by Mobile Applications
Our Services are primarily provided through an application on your mobile, tablet computer or similar device (“Mobile Application”). You agree that we may collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such Mobile Applications.

When you use any of our Mobile Applications, the Mobile Application may automatically collect and store some or all of the following information from your mobile device (“Mobile Device Information”), including without limitation:

  • Your preferred language and country site (if applicable)
  • Your phone number or other unique device identifier assigned to your mobile device – such as the International Mobile Equipment Identity or the Mobile Equipment ID number
  • The IP address of your mobile device
  • The manufacturer and model of your mobile device
  • Your mobile operating system
  • The type of mobile Internet browsers you are using
  • Your geolocation
  • Information about how you interact with the Mobile Application and any of our web sites to which the Mobile Application links, such as how many times you use a specific part of the mobile application over a given time period, the amount of time you spend using the Mobile Application, how often you use the Mobile Application, actions you take in the Mobile Application and how you engage with the Mobile Application
  • Information to allow us to personalize the services and content available through the Mobile Application

We may use information automatically collected by the Mobile Application (including the Mobile Device Information) in the following ways:

  • To operate and improve our Mobile Applications, other Services, our company’s services, and tools;
  • To create aggregated and anonymized information to determine which Mobile Application features are most popular and useful to users, and for other statistical analyses;
  • To prevent, discover and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the Mobile Application, and to investigate fraud, chargeback or other matters;
  • To customize the content or services on the Mobile Application for you, or the communications sent to you through the Mobile Application.

With respect to geo-location data we track through your Mobile Device, we use that geo-location information for various purposes – including for you to be able to view the drivers in your area that are close to your location, for you to set your pick up location, so the drivers are able to find the location from which you wish to be picked up, to send you promotions and offers, and to allow you (if you choose through any features we may provide) to share this information with other people. Except as otherwise permitted in this Privacy Policy, we will not share this information with third parties for any purpose and will only use this information for the sole purpose of providing you with the ability to request transportation via SPOT’s Mobile Application. You may at any time no longer allow our Mobile Application to use your location by turning this feature off at the Mobile Device level.

We also provide some of your Personal Information (such as your first name and your photo, if you have chosen to upload your photo to your profile) to the driver/partner who accepts your request for transportation so that the driver may contact and find you, and to those users with whom you have agreed to split the fare for a particular trip. The companies for which drivers work (that are providing the transportation service) are also able to access your Personal Information, including your geo-location data.

We may associate your unique mobile Device Identifier or Mobile Application usage information with any Personal Information you provide, but we will treat the combined information as Personal Information.

Personal Information may also be collected and shared with third-parties if there is content from the Mobile Application that you specifically and knowingly upload to, share with or transmit to an email recipient, online community, website, or to the public, e.g. uploaded photos, posted reviews or comments, or information about you or your ride that you choose to share with others through features which may be provided on our Services. This uploaded, shared or transmitted content will also be subject to the privacy policy of the email, online community website, social media or other platform to which you upload, share or transmit the content.

Financial Information
As discussed above, we do not currently collect financial information – that information is collected and stored by our Payment Processor(s). However, we may from time to time request and receive some of your financial information from our Payment Processor for the purposes of completing transactions you have initiated through the Services, enrolling you in discount, rebate, and other programs in which you elect to participate, protecting against or identify possible fraudulent transactions, and otherwise as needed to manage our business.

Information You Elect to Share with us:
We tell you how we intend to use your data when you submit it to us – for example, for the use of Site features, response to advertisers, information requests, products or services purchases, survey responses, or other purposes. Some of your activity is public by default, i.e. content you publicly post and some profile information. Account holders have this data associated with them. Unregistered users have anonymous information tracked (such as what pages they have visited) through cookies and stored by us.
If you share Personal Information using certain public features of the Site, other people who see it may share that information without your control or knowledge. Specifically – people will know where you are parked. Be careful when sharing Personal Information through publicly accessible websites and services.

Aggregate Information:
We share Aggregate Information with our partners, service providers and other business partners so they can understand how and how often people use our Services and their services or websites. This facilitates improvements of our Services’ interface with them. In return, these third parties may share aggregate or other non-Personal Information about you that they have independently developed or acquired.

User Profile Information:
We share your username with other users and only the other Personal Information that you elect to share in the Account. Please keep in mind that you will need to share Personal Information with other users in order to complete a parking transaction through the Site.

Information Shared with our Partners:
We work closely with other businesses that sometimes sell or promote products to you through our Services. We will clearly state when one of our partners is associated with a transaction, and we will share your Personal Information that is related to such transactions with that business, unless you have opted out of marketing partner communications during Account registration or through your Account settings.

Information Shared with our Agents:
We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our “Agents”). We may need to share Personal Information with our Agents in order to provide the Services. Unless we tell you differently, our Agents do not have any right to use Personal Information or other Information we share with them beyond what is necessary to assist us. By using the Services, you automatically consent to our sharing your Personal Information with our Agents.

Information Disclosed Pursuant to Business Transfers:
If our business gets acquired, we sell substantially all of our assets, or we go out of business, user Information would be one of the assets that is transferred or acquired by a third party. You acknowledge that this is ok, and that any acquirer of us or our assets may continue to use your Personal Information in accordance with this Privacy Policy.
Information Disclosed for Our Protection and the Protection of Others:
We also reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the terms and conditions of the Services you utilize, including to investigate potential violations thereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect our rights, property or safety, our users and the public. This includes exchanging Information with other companies and organizations for fraud protection and spam/malware prevention.

Information We Share With Your Consent:
Except as set forth above, you will be notified when your Personal Information may be shared with third parties, and you will be able to prevent the sharing of such Personal Information.
Security of Person Information:
Your Account is password protected for your privacy and security. Please don’t give out your password, and please sign out of public computers when accessing your Account. We try our best to protect your security, but we can’t guarantee it. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.
International Users: we process data in the United States & United States’ data protection laws are different
If you are located outside of the United States, note that the Site is (i) hosted by computer servers in the United States, (ii) processes and stores data in the United States, and (iii) United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your Information through laws applicable in the United States. If you use the Site or Services or share Personal Information with us, then this constitutes your consent to the transfer of your Personal Information outside of your home country, including the United States.

Avoid Phishing
Safeguarding your information is important to us and we appreciate your cooperation in doing the same. Identity theft and “phishing” are rampant and problematic. How Do I Access My Information?
If you created an Account, just login and access it through your Account settings. If not, just delete cookies through your web browser settings.

For California users: California Privacy Rights: Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of personal customer Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact Information for such affiliates and/or third parties. Can I Delete My Account?
Yes. All you need to do is login and delete it through your account settings. Activity generated prior to deletion will remain stored by us and may be publicly accessible.

Children’s Privacy
This Site is not directed to any individual that is too young to have a driver’s license in the state in which he or she accessing the Site. We do not knowingly collect Personal Information from individuals under those ages.

Compliance with Law
We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information (including Personal Information), including disclosure to third parties such as government or law enforcement officials or private parties as we reasonably determine is necessary and appropriate: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process; (ii) to protect and/or defend the Terms and Conditions for online and mobile Services or other policies applicable to any online and mobile Services, including investigation of potential violations thereof; (iii) to protect the safety, rights, property or security of the Company, our Services or any third party; (iv) to protect the safety of the public for any reason; (v) to detect, prevent or otherwise address fraud, security or technical issues; an /or (vi) to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity. Further, we may use IP address or other Device Identifiers, to identify users, and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies, including disclosing such information to third parties, all in our discretion. Such disclosures may be carried out without notice to you.

Business Transfer
We may share your information, including your Personal Information and Usage Information with our parent, subsidiaries and affiliates for internal reasons. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our membership interests and/or assets or other corporate change, including, during the course of any due diligence process.

What Happens When There Are Changes to this Privacy Policy?
We may supplement, amend and otherwise modify this Privacy Policy from time to time. Information we collect is subject to the policy in place at the time it is collected. If we make any changes, we’ll notify you by email or by posting a notice on the Site. You are bound by the Privacy Policy as in effect at the time that you use any of the Services.
